10.2 These terms and conditions, as amended from time to time by BML in its sole discretion, constitute the entire agreement between you and BML in relation to the subject matter of the terms and conditions.
10.3 No failure or delay to exercise any of BML’s rights will be construed as a waiver of any such right, whether express or implied, nor will it affect the validity of any part of these terms and conditions or prejudice BML’s rights to take subsequent action against you.
10.4 If any of these terms, conditions or provisions are held to be invalid, unlawful or unenforceable, such term, condition or provision will be deleted from the remaining terms, conditions and provisions, which will continue to be valid to the full extent permitted by the law.
10.5 The provisions of these terms and conditions must be read in conjunction with the privacy policy pertaining to this website and such privacy policy shall be deemed to be incorporated herein.

USSD Lending Terms and Conditions
These USSD Lending Terms and Conditions (“said T&C”) (as amended from time to time) are applicable to the customers of Bayport Savings and Loans PLC (“Institution”) availing the Banking Services on the USSD platform. This said T&C shall be in addition to other terms and conditions as stipulated by the Institution from time to time on its website i.e. www.bayportghana.com in relation to its banking products, services, facilities or offers.
This USSD Banking Services (“said Services”) offered by the Institution through its USSD Banking Platform is at the sole discretion of the Institution for its eligible customer and are subject to the terms and conditions mentioned herein:
These Terms and Conditions take effect (begin) when you register for USSD Lending Service. Bayport may change these Terms and Conditions from time to time. The latest version of the Terms and Conditions applies each time you use our USSD Lending services.
You must read these terms carefully before using the Service. By registering to use the service or also by virtue of your continued usage of the Service, you shall be deemed to have accepted and be bound by these terms as well as other terms governing the service, as amended from time to time. If you reject these terms and conditions you cannot use the functionalities of our USSD lending services and cannot continue to Log-on to these services.
- The said Service cannot be used for grievance redressal or reporting fraud, the Institution shall not be held liable for any such incidents reported through the said service.
- The Said T&C may be withdrawn/superseded/ modified at any time whatsoever, by the Institution without any prior notice to the customer.
- Customer shall ensure appropriate network connection, receipt of messages by Customer shall be subject to the network connection and the Institution shall not be held responsible for any delay or non-receipt of the responses from the Institution.
- The Institution will offer the undermentioned services under the said service:
– Payroll Lending. - Customers shall not submit or transmit any content through the said service as mentioned herein below:
– Obscene, Vulgar, or Pornographic
– Encourages the commission of a crime or violation of any law
– Violates any state or Central law in Ghana and/or the jurisdiction in which you reside and/or any applicable law.
– Infringes the intellectual or copyrights of a third party - Under no circumstances shall the Institution, or its agents, affiliated companies, officers, directors, employees, and contractors be liable for any direct, indirect, punitive, incidental, special, or consequential damages that results from the use of, or inability to use, the said service or for receipt of any answer provided by the program running at the back-end.
- The customer hereby understands and agrees that using the said service may carry extra risks which may not be secured. Further, any message and information exchanged is subject to the risk of being read, interrupted, intercepted by a third party or otherwise subject to manipulation by a third party or involve delay in transmission.
- The Institution shall not be responsible or liable to the customer or any third party for the consequences arising out of or in connection with using of the said service.
- The customer shall be solely responsible for all the communication exchanged between him/her and the Institution while using the said service.
- The customer agrees that he/she will not have any claim against the Institution on account of any suspension, interruption, non-availability or malfunctioning of the said service due to any link/mobile/system failure at the Institution’s end for any reason thereof.
- The Customer hereby authorizes the Institution for carrying out the Services as requested by the Customer on the USSD platform on his/her mobile number registered with the Institution and the Institution will have no liability for any fraud or impersonation incidents through the USSD platform.
- The Customer agrees and accepts that the Institution reserves the right to provide only such Services as the Institution may at its discretion permit from time to time. The Customer further agrees and confirm that the Institution may at any time, without notice to the Customer, modify, discontinue or make additions/deletions to the Services offered to the Customer.
- In case of conflict between any of the Said T&C and the terms and conditions for other banking products, services or facilities provided on the Institution’s USSD Platform, specific terms and conditions of such products, services or facilities shall prevail. Further, in case of inconsistency between the said T&C and any other specific terms and conditions pertaining to a specific variant of the account or any specific products, services or facilities, the specific terms and conditions of such particular products, services or facilities shall prevail.
- By applying and opting in for the said Services, the Customer acknowledges that he/she has read, understood and accepted said T&C and other specific terms and conditions as pertaining to the Account and any other products, services or facilities and such products, services or facilities availed by the Customer whether or not through the USSD platform.
- The Courts in Ghana shall have exclusive jurisdiction regarding any claims or matters arising out of dealings with us, and all disputes will be governed by the laws of Ghana.
WhatsApp Banking Terms and Conditions
These WhatsApp Terms and Conditions (“said T&C”) (as amended from time to time) are applicable to the customers of Bayport Savings and Loans PLC (“Institution”) availing the Banking Services on the WhatsApp platform. This said T&C shall be in addition to other terms and conditions as stipulated by the Institution from time to time on its website i.e. www.bayportghana.com in relation to its banking products, services, facilities or offers.
This WhatsApp Banking Services (“said Services”) offered by the Institution through its WhatsApp Banking Platform is at the sole discretion of the Institution for its eligible customer and are subject to the terms and conditions mentioned herein:
- The said Service cannot be used for grievance redressal or reporting fraud, the Institution shall not be held liable for any such incidents reported through the said service.
- The customer who has subscribed to the said service shall have to delete WhatsApp on changing his/her device.
- The Said T&C may be withdrawn/superseded/ modified at any time whatsoever, by the Institution without any prior notice to the customer.
- Customer shall ensure appropriate network connection, receipt of messages by Customer shall be subject to the network connection and the Institution shall not be held responsible for any delay or non-receipt of the responses from the Institution.
- The Institution will offer the undermentioned services under the said service:
– Payroll Lending. - Any feature addition and removal on WhatsApp channel is at the sole discretion of the Institution.
- Customers shall not submit or transmit any content through the said service as mentioned herein below:
– Obscene, Vulgar, or Pornographic
– Encourages the commission of a crime or violation of any law
– Violates any state or Central law in Ghana and/or the jurisdiction in which you reside and/or any applicable law.
– Infringes the intellectual or copyrights of a third party - Under no circumstances shall the Institution, or its agents, affiliated companies, officers, directors, employees, and contractors be liable for any direct, indirect, punitive, incidental, special, or consequential damages that results from the use of, or inability to use, the said service or for receipt of any answer provided by the program running at the back-end.
- The customer hereby understands and agrees that using the said service may carry extra risks which may not be secured. - The customer is solely responsible for keeping security safeguard of his WhatsApp Account linked to the registered mobile number for using the said service at all times.
- The customer agrees that he/she will not have any claim against the Institution on account of any suspension, interruption, non-availability or malfunctioning of the said service due to any link/mobile/system failure at the Institution’s end for any reason thereof.
- WhatsApp is owned by a third-party who is not affiliated with the Institution. The Customer shall be solely responsible and shall have to adhere with and be guided by their privacy policies and the Institution has no control over it nor is the Institution responsible for the privacy or security policies thereof or any other third-party sites and/or applications that may be linked to the said service. The Institution does not validate and is not accountable for any ads, content, products, advice, opinions, recommendations or other material of third-party sites and/or applications that may be promoted via advertising within any social media properties.
- The Customer hereby authorizes the Institution for carrying out the Services as requested by the Customer on WhatsApp on his/her mobile number registered with the Institution and the Institution will have no liability for any fraud or impersonation incidents through the WhatsApp platform.
- The Customer agrees and accepts that the Institution reserves the right to provide only such Services as the Institution may at its discretion permit from time to time. The Customer further agrees and confirm that the Institution may at any time, without notice to the Customer, modify, discontinue or make additions/deletions to the Services offered to the Customer.
- In case of conflict between any of the Said T&C and the terms and conditions for other banking products, services or facilities provided on the Institution’s WhatsApp Platform, specific terms and conditions of such products, services or facilities shall prevail. Further, in case of inconsistency between the said T&C and any other specific terms and conditions pertaining to a specific variant of the account or any specific products, services or facilities, the specific terms and conditions of such particular products, services or facilities shall prevail.
- By applying and opting in for the said Services, the Customer acknowledges that he/she has read, understood and accepted said T&C and other specific terms and conditions as pertaining to the Account and any other products, services or facilities and such products, services or facilities availed by the Customer whether or not through WhatsApp.
- The Courts in Ghana shall have exclusive jurisdiction regarding any claims or matters arising out of dealings with us, and all disputes will be governed by the laws of Ghana.
